Payment
Flatiron Guitars accepts all major Credit Cards and PayPal. On international orders we require PayPal. We sell and ship items internationally.
Shipping
Free U.S. shipping (excluding Alaska, Hawaii and PR) on most items except for specialized and oversized items. See individual item for possible shipping charge details or contact us. All International sales are Final. International shipping available, please contact us for a quote.
At Flatiron Guitar, we offer a 7-day return period on new items and used items from the time you receive it. Items may be returned for refund. To qualify for a refund, items must be in original, new condition with all materials, paperwork and accessories intact. Some items may not be returned, and the sale is final. Please choose carefully before buying these items.
Return Policy - Shipping
Shipping fees and return shipping costs are not refundable or reimbursed for any reason. Returned items are to be shipped and fully insured and show no signs of wear, use, or damage. All shipping charges both outbound and inbound are to be borne and insured by the customer. Returned product must be sent using the same carrier, service, and insurance as delivery.
To Return an Item
Please contact us to process the request for return authorization. Upon receiving your authorization, package your item securely, and ship it back to us via the same carrier. Remember you are the shipper and it is your responsibility to properly package and insure the item. If an Item is damaged in transit back to us, we cannot accept it for return. It will be up to you to file a damage claim with the shipper. If an item arrives without authorization, delivery will not be accepted. We require a tracking number within 24 hours of return request.
Allow 2 weeks (from delivery at our location) for returns to be inspected, restocked, and processed for refund. Refunds can take up to 7 days for it to show up on your credit card once processed.
Return Policy - Product Specifications
Product specifications & features are subject to change without notice. Photographs are typically of the actual guitar. Please note that colors can be affected and even altered by your monitor and its settings. There will likely be some variance in color due to the many variables of viewing photos online.
Return Policy - Product Playability / Action / Setup
Musical Instruments are made of wood and are subject acclimation (changes in climate). Setup, playability, and "action" are subject to change by the very nature that the climate, temperature, humidity, and other factors change when the instrument is taken from one environment to another. Guitars can and often do require adjustment upon arrival. When the neck of a guitar dries out, it pulls back and can buzz, or when it is more humid it can relax the wood and the neck can pull forward and the strings can be too high. Also, if a guitar is tuned, but not to a proper "A 440" with a tuner and is pitched too low, it can buzz as well. We make no guarantee either express or implied as to the playability of an instrument that is not adjusted locally to your climate. We will gladly assist you over the phone with any advice on adjustment but cannot make return policy exceptions based on playability which is subjective. Guitars do need adjustment periodically, especially when being purchased mail order.
Offer and Acceptance
Products displayed on the Website do not constitute an offer to sell. It is an invitation to treat only.
In placing an order for and making payment of the purchase price of a Product, you are making an offer to Flatiron Guitars to purchase that Product under these Terms.
Flatiron Guitars reserves the right to reject any offer made by a Customer for any reason whatsoever (including but not limited to the unavailability of the Product, an error in the price or Product description, or an error in the Customer’s order).
Additional Terms and Conditions
Customer shall be responsible for his or her own actions in using this web site or purchasing from Flatiron Guitars. In the event the customer disputes any credit card charges for purchases where delivery was made, customer shall be responsible for all collection’s costs, attorneys’ fees, court costs, and any and all costs associated with collection. In the event an order is placed, and then shipment is refused, or order is cancelled prior to shipment, customer shall be responsible for 10% restocking fee plus a $10.00 fee, plus the shipping company published rate for delivery and for return to us. Any customer accepting a shipment, and then disputes the credit card charges with their issuing bank will be immediately turned over to our third-party collection agency and incur additional fees. Customer agrees by placing an order either over the phone or electronically to all terms, policies, and conditions contained within this web site. The transfer of ownership occurs at the time Flatiron Guitars hands the goods off to the carrier for transport. After such time, the customer is entitled to our return policy and all manufacturers warranties. The customer shall release and indemnify Flatiron Guitars LLC, its agents, affiliates, employees, and suppliers from any and all liability including but not limited to: Delayed shipment, delayed delivery, back order, malfunction, defective, damages, injury or death from abuse or misuse, or statements of specifications or usability or estimations on shipment or delivery time or date.
You acknowledge and agree that:
To the maximum extent permitted by law, Flatiron Guitars will not be liable to the Customer or any other person under any circumstances for any loss or damage suffered or incurred by the Customer or for any injury or death to any person, or for any indirect, incidental or consequential damages sustained or incurred by the Customer, whether such liability arises directly or indirectly as a result of:
- any negligent act or omission or willful misconduct Flatiron Guitars or its employees or agents;
- the supply, performance or use of any Products; or
- any breach by Flatiron Guitars of its obligations under these Terms.
No other term, condition, agreement, warranty, representation or understanding (whether express or implied) in any way binding upon Flatiron Guitars, other than these Terms, is made or given by or on behalf of Flatiron Guitars.
The Customer is solely responsible for making an assessment that any Product is reasonably fit for the Customer’s intended purpose and required use, and such purpose or required use is in accordance with all applicable laws.
Intellectual Property
The Customer’s purchase of a Product does not confer on the Customer any assignment of any Intellectual Property Rights that subsists in any of the Products or any other materials supplied by Flatiron Guitars, and the Customer agrees that it will not assert any rights in, or challenge Flatiron Guitars title to, those Intellectual Property Rights.
Flatiron Guitars makes no representation or warranty to the Customer of any kind, express or implied that the Products will not infringe any intellectual property rights of a third party.
The Customer acknowledges that Flatiron Guitars retains ownership of all rights, title, interest and goodwill in the Intellectual Property Rights that subsists in any of the Products or any other materials supplied by Flatiron Guitars (including user guides, instruction manuals and other documents).
Flatiron Guitars grants to the Customer, and the Customer accepts, a personal non- exclusive license to use the Intellectual Property Rights that subsists in any of the Products or any other materials supplied by Flatiron Guitars (including user guides, instruction manuals and other documents) for the purposes of these Terms.
The Customer shall not be permitted to assign, transfer or sub-license any of the rights granted to it by Flatiron Guitars to any related party or any unrelated third party without the express consent in writing of Flatiron Guitars. Fusion may withhold such consent in its absolute discretion or may grant consent on such terms as it considers fit.
The Customer shall not re-publish, transfer, copy, reproduce or post on the internet any of Flatiron Guitars materials without Flatiron Guitars prior written consent.
In addition to any other remedies available to Flatiron Guitars under these Terms or otherwise, any unauthorized use, alteration, modification, reproduction, publication, disclosure or transfer of the Intellectual Property Rights will entitle Flatiron Guitars to any available statutory or equitable remedy against the Customer.
The copyright in the Website, copy, images, logos, indicia, text, content, and unique method of showcasing products is owned by Flatiron Guitars. The domain name www. Flatiron Guitars.com. or any of the trademarks, logos or other material in which intellectual property rights subsist may not be used in advertising or publicity pertaining to distribution of this information without Fusion’ prior written consent.
